Brian P. Kinder is an associate and a member of the Litigation and transactional Intellectual Property (IP) departments of Hart, King & Coldren.  As a litigator, his practice focuses on resolving complex business, commercial, and real estate disputes, with a particular emphasis in the areas of breach of contract, trademark and copyright infringement, false advertising, misappropriation of trade secrets, unfair competition, franchise disputes, landlord and tenant, director and officer liability, employment counseling, leasing and other real estate matters.

On the IP transactional side, Mr. Kinder has handled IP matters in over 120 countries and is well versed in both domestic and international trademark, copyright, and advertising laws.  He routinely works with clients in developing and expanding their intellectual property portfolios as well as promoting and selling their products and services throughout the world.  He has successfully resolved several high profile domain name disputes and trademark enforcement proceedings before the Trademark Trial and Appeal Board (TTAB) and regularly drafts and negotiates copyright and trademark license agreements, work for hire agreements, model releases, web site use policies and domain name registration agreements. 

Mr. Kinder represents clients from a wide variety of product industries, including, apparel, building materials, consumer electronics, food and beverage, health and beauty, horticulture, pharmaceutical, sports nutrition, sporting goods, toys and transportation products.  He is also experienced in representing clients across various service industries, including advertising/pr agencies, banking institutions, homeowners associations, insurance brokers, financial advisors, magazine publishers, restaurants, and real estate sales and leasing organizations. Mr. Kinder regularly authors articles on the topics of creating, maintaining and protecting intellectual property rights and has given numerous presentations on these topics to advertising clubs, restaurant owners, action sports retailers and members of both the American Inns of Court and California State Bar.
